The content of our website has been compiled with meticulous care and to the best of our knowledge. However, we cannot assume any liability for the up-to-dated-ness, completeness or accuracy of any of the pages. We as service providers are liable for our own content on these pages in accordance with general laws. However, we as service providers are not under obligation to monitor external information provided or stored on our website. Once we have become aware of a specific infringement of the law, we will immediately remove the content in question. Any liability concerning this matter can only be assumed from the point in time at which the infringement becomes known to us.
Limitation of liability for external links

This Data Protection Declaration declares the nature, the extent and the scope of the collection and usage of personal data of visitors and users (following both referred to as "user"), by Evolving Up LLC (following referred to as "supplier") as sole responsible for collecting, storing and using the data correctly in accordance with the legislation on data protection. A visit to our website can result in the storage on our server of information about the access (date, time, page accessed). This does not represent any analysis of personal data (e.g., name, address or e-mail address). If personal data are collected, this only occurs - to the extent possible - with the prior consent of the user of the website. Any forwarding of the data to third parties without the express consent of the user shall not take place. We would like to expressly point out that the transmission of data via the Internet (e.g., by e-mail) can offer security vulnerabilities. It is therefore impossible to safeguard the data completely against access by third parties. We cannot assume any liability for damages arising as a result of such security vulnerabilities. The use by third parties of all published contact details for the purpose of advertising is expressly excluded. We reserve the right to take legal steps in the case of the unsolicited sending of advertising information; e.g., by means of spam mail.
Server Data
For technical reasons, data such as the following, which your internet browser transmits to us or to our web space provider (so called server log files), is collected: - type and version of the browser you use - operating system - websites that linked you to our site (referrer URL) - websites that you visit - date and time of your visit - your Internet Protocol (IP) address. This anonymous data is stored separately from any personal information you may have provided, thereby making it difficult to connect it to any particular person. The data is used to improve our website, services and security.
Personal Data Protection
Personal Data shall only be collected and used by the supplier, if legally allowed or approved by the user. In general, it is obvious to the user what data is being saved while using the service, e.g. Name, E-mail address and notification by usage of the order form. For the purpose of ordering items, collected data (e.g. name, e-mail-address, address, payment data) will be used for the fulfillment and processing of the contract. We treat all data as strictly confidential. For data protection reasons, it is transmitted securely using encoding and will not be passed on to third party, that is not involved in the order, delivery or payment process. By contacting the supplier (per contact form or email), we save the personal data, for the purpose of processing the inquiries as well as for the case of arising follow-up questions. The supplier has met organizational, contractual and technical safety measures, to make sure, that the data security provisions are observed and accidental or intentional manipulation, loss, damage or the access of unauthorized people are prevented.
Data Forwarding to Third-Party
User data is only passed on to third party, if it is legally allowed or the user has approved. For example, if competent authorities in the field of law enforcement request the data. The user's personal data will in no way be passed on to third parties for advertising purpose or for creating user accounts to sell or pass on.
Cookies
We use cookies to optimize the user-friendly navigation and usage of our website. Cookies are small files with text information that are stored on your hard drive while you visit our site. We need the cookies to identify and authorize you after your successful registration in the protected area, for the full duration of your visit. However, cookies also serve to track the preferences of website visitors. This helps us to better customize our website contents to your needs and to improve our offers for you. Newsletter
Our website may offer you the opportunity to subscribe to our newsletter. The newsletter provides you periodically with information about our services. To receive our newsletter, we require a valid email address. We will review the email address you provide for the purpose of determining whether you are in fact the owner of the email address provided or whether the actual owner of said address is authorized to receive the newsletter. When subscribing to our newsletter, we will store your IP address as well as the date and time you subscribed. This serves to protect us in the event a third party improperly and without your knowledge makes use of your email address to subscribe to our newsletter. We will not collect any other data. The data thereby collected is used solely for the purpose of receiving our newsletter. No data is transferred to third parties. Nor is any of this information matched to any information that other components of our website may collect. You may cancel your subscription to the newsletter at any time. You will find additional details in the email confirming your subscription as well as in each newsletter.
Use of "In-House" Analytics
We use an "in-house" analytics service (i.e. an analytics system we host ourselves and retain all the data on our servers), and we do not transmit or sell your data to any third party. Our analytics service is based on cookies and allows an analysis of website usage. We have not activated IP anonymization for our website, as we use that as additional way to block bad bots to make our website more secure. You can opt-out of our analytics service in the box below or enable the "Do Not Track" option in your browser (which of course we honor and recommend you enable regardless):
Blocking of Big Data Tracking
In our experience, it's very difficult to create a modern web service that excludes all big data tracking. Because internet privacy is important to us, we work hard to block any and all ways we can find that big data and social media companies track you. We endeavor to host our own fonts, avatars, scripts, widgets and newsletter services, and commit to continue to find and block any trackers that may be inserted by third party software developers. We try to host all of our own videos, but for technical reasons, occasionally we may have to use YouTube/Vimeo embeds; when we do, we try to ensure it is a non-tracking version. Besides that, we don't use third party analytics, tracking embeds or external links with tracking mechanisms. For services we can't reasonably provide ourselves, we use a handful of companies we trust and value: Scala Hosting for virtual private server services and email. Linode for object storage services (mostly for video). Cloudflare for firewall, CDN, DNS and caching services. hCaptcha on some select pages for anti-bot services. Amazon Web Services for bulk email sending services. To the best of our knowledge, these specific services from these companies are more respectful to your data than the average company. Please refer to each of their policies for details. FYI: We are still temporarily using MailChimp for legacy email newsletters for some of our older sites. We are moving away from that services as soon as possible.
Information/ Cancelation/ Deletion
As we are based in the United States in the state of Colorado, we follow applicable law. However, as we do not believe the laws in our jurisdiction offer sufficient rights and protections to your data, we endeavor to implement said rights and protections found in Europe and California. As such, you may contact us at no cost if you have questions relating to the collection, processing or use of your personal information, if you wish to request the correction, blocking or deletion of the same, or if you wish to cancel explicitly granted consent. We support the right you we think you should have to correct incorrect data or to delete personal data, where such claim is not barred by any legal obligation to retain this data.
Amendment to the Data Protection Declaration
The supplier reserves the right, to change the data protection declaration, to adjust it to modified legislation or by change of service or data handling.
